Some 200 locations have been identified as establishments used for the sex trade in Penang, Penang Stop Human Trafficking Campaign acting director James Lochhead said.

He said some of these locations housed migrants who were trafficked into the country and were forced into the sex industry.

Lochhead said a one-year research done by case worker Todd Morrison with Jaringan Utara Migrasi Pulau Pinang (JUMP) revealed that there were four major categories of users.

"To say there are about 200 establishments including reflexology centres, then there is a very high possibility of human trafficking. Perhaps about 10 and 20 might be involved in trafficking.

"As for the types of users, they comprise residents, businessmen, tourists and migrants. Therefore we must be clear what role different people play in this sordid world of human trafficking. It will assist us in devising appropriate strategies and messages to prompt better awareness.

"Perhaps with the state's support, we can work with the tourist industry to take the messages in the appropriate way into our hotels," he said.

Lochhead said the authorities should also change the approach as women who are picked up during raids at sex trade joints are often criminalised rather than their customers, pimps and owners of the premises.

"According to Morrison's findings, about 29,000 foreign women, suspected of prostitution were arrested in the raids between 2008 and 2010. However, within that same period of time, the government only rescued 189 victims of sex trafficking that was a mere 0.7%.

"We are not saying that all foreign sex workers are trafficked but that the figure is low particularly when compared to Human Rights Commission of Malaysia (Suhakam)'s report," he said.

The report based on interviews conducted with foreign women detained in prisons or detention camps revealed that between 20% and 50% of them "exhibited" signs of having been trafficked, he said.

"In other words, we are very bad at identifying victims of trafficking. Why? Because as Suhakam says Malaysia considers and treats victims of human trafficking as illegal immigrants so that in the first instance they are treated as unwanted aliens and deported as an undocumented migrant before they are identified as a victim.

"We need to be more sensitive. When the authorities raid, they need to find out how they were brought in ... whether they were trafficked or not, and document it," he said at the re-launch of the Stop Human Trafficking Campaign event.

The campaign was launched in October last year, but re-launched today by US Ambassador to Malaysia Joseph Y Yun, who later presented a US$17,000 (RM54,550) cheque to the Penang branch of the National Council of Women's Organisations.

Lochhead said that in terms of sex trade locations, the campaign committee could work with the local councils to ensure licensing of premises is done more stringently and took into consideration the possibility of humans having trafficked into Penang.

He said there seemed to be "very few" prosecutions of employers or agents engaged in human trafficking.

He cited the example of certain errant labour agencies that are engaged by employers to look for foreign workers but despite being under the auspices of the Home Ministry, the manner by which workers are sourced abroad and brought in was questionable.

"We do not know how the labour resources are sourced from abroad. What is promised to the potential migrants, how they arrived in this country whether legally or illegally," he said.

He proposed that businesses utilise the "fair labour audit" currently used by multinational corporations that employ foreigners.

The audit was a checklist that requires the employer to ensure that the criteria is fulfilled including wages, deductions and placed in proper accommodation, he said, adding that the state government could oversee this annual responsibility.

When asked, State Women, Youth and Sports, Family and Community Development Chong Eng said the government will look into the proposal.

However, "business is business", she said, adding that the state could not force employers to take part in the audit.
